Boumediene v. Bush was yet another 5-4 ruling. I am one of those who ponder how it is that top legal minds can be so divided on constitutional issues.

While it is common to fear that rulings illustrate the power of partisan presidential nominations, it is notable that seven of the current justices were appointed by Republican presidents.
