Well maybe, maybe not.  Tobacco is now a controlled substance, regulated at some levels by the federal government.  It is also well known that tobacco is addictive (as a former addict I know all too well how addictive smoking can be) and we also know that 2nd hand smoke does cause ill heath effects.

All that said there is a point where personal choice comes into the picture.  I enjoy going to Tyler's for a beer much more then I enjoy The Flying Saucer.  Both have excellent beer selections but Tyler's taproom (not the Speakeasy in the back) is smoke-free and I find that I have a more enjoyable dinner in a smoke free environment.

I wish more bars would take the initiative to make their own establishments smoke-free but I can understand why they would not.  A business is a business and if a bar owner could attract more customers in a smoke-free environment and make more money I think they would have already.

In the end I think that a smoking ban in public places is unavoidable.  Even Paris (the place) went smoke free in restaurants.  If you have ever been to Paris before the ban went in place (and I have not been there since, so I can't comment first-hand) I would have said that a smoke-free Paris would happen around the same time as the end of the world.

That is a bullshit answer. There is a difference in assault and being able
to decide if an establishment is smoking or not. Yo sir are what is wrong
with the US, you and your want for a nannie society.
