The requirement for all to use ICS / NIMS is not limited to federal incidents. ICS is required to be used at every incident nationwide, expanding to NIMS as needed.

The basic question is whether your unit will participate in multi-state or
Federal incidents.
Federal rules only apply when they are paying for it or running it. And it
is not always clear even in multi-state incidents if the Feds are in charge
due to the emergence of other mechanisms for mutual aid (EMAC for instance)
which do not include federal coordination.

For instance, in a lost minor child search the FBI is supposed to check in
within 24 hours due to the possibility of interstate transportation of the
child. But, unless there is proven foul play or proof of crossing a state
line they are not in charge, the local police are.
