Nobody here is claiming HSPD are laws. However, as previously mentioned, federal funding is attached to NIMS compliance. An authority having jurisdiction can choose to not be compliant with NIMS, or even an entire state. But failure to be compliant means no federal funding, so I don't see any states saying no to NIMS. And if the state wants the substantial funding related to compliance, you can bet they'll lean on the locals to comply.

Are states and locals happy about being "forced" to be NIMS compliant? Nope. But long term it is certainly advantageous for all first responders, emergency management, etc., to be on the same page.

ICS works. SEMS (the CA model used for NIMS) is a proven, very effective process. With the entire country implementing ICS and NIMS, it makes little sense (and loses substantial financial aid) to be a local hold-out.

idea is common in the SAR community. However, it appears

and HSPD-8 for short) are often cited as the legal basis,
