I don't think it's that cut and dry. If someone were willing and had the
capital to support a lawsuit, I believe the courts would recognize the
incongruity of such a situation. Unfortunately, it would take a lot of
capital to pursue this through the system. Equally unfortunately, it
demonstrates that without enforcement, and committment by the people, there
is no law. Major corporations know that and have budgets built in to wear
down opponents legally. But I believe this issue, along with herbicide
drift, is ripe for the picking for someone with the will and capital to
pursue it.
