While I see what you're trying to get at here, I think you may
have perhaps taking it a bit too far. What if it's a whistleblower
trying to e-mail everyone in the company about something unethical
the company is doing? The company could go after that person as
a spammer with the law you've described. I'm not sure what a good
compromise would be, though.

Oh, and one other thing. When you say "faking headers must be punishable"
you should also be more specific too. Say, faking headers to indicate
that this message comes from a particular e-mail address or domain or
path should be punishable and not adding an X-MyCustomHeader. Yes,
I agree that sounds somewhat silly, but I'd rather be more specific
than less specific in this case because this is america and if there's
a new way to sue someone, somebody will use it. *sigh*
