My ex worked in a Unionized job at Amtrak. The union will defend members for almost anything (one tried to run down his boss with a truck, and they defended him!), but there are automatic consequences to failing a drug test. They did fight to get rehab included.

To further answer the questions, Rob, I suppose one always has a choice.
You don't *have* to prove anything or provide samples, but if you
don't, then the consequence of that is that you lose your employment or
you are not hired.
I've never worked in a place where employees were unionized, but I'm
guessing that might affect things.
