It is prosecuted but it has to be incitement with intent. Kinda like hollering fire in a movie theater. You have to know, or a "reasonable person would know" that their actions would have an immediate detrimental effect on others.

If you are talking about government crimes of x, y or z and something should be done about it and in that speech you describe how to make a pipe bomb or where to find directions to make a pipe bomb, *then* you could/should be arrested, charged and prosecuted.

If you are doing what most of these people are doing and saying "we want change" or "we don't want more government," then you aren't "inciting."

However, I think the crime that should be punished is the higher ups who are sending people in to make the legitimate protesters look bad!

Very true, then she continues on to say the leaders should face the
consequences of the actions of their followers, who will she decide the "leaders"
are and what punishment will she demand? Also, following her line of
thinking, shouldn't some big players be charged for the indiscretions of the
acorn workers? They are again laying the blame on lowly worker bees, but the
heads should pay the price. Same for these environmental groups carrying out
assaults on people and property. It would also apply to leaders of the pro
life movement when lowly followers kill abortion doctors etc. The problem
with this line is that we don't normally hold someone responsible for the
crimes of another, particularly when they were unaware of the perpetrators
intent. I do think some responsibility exists, when specific incitement is
evident, but that is pretty rare.
