so your saying that the nonprofit, in order to circumvent the NC condition, gives the NC item away in exchange for people registering for memberships for which they pay but that the money gets accounted by the nonprofit as sales by the gift shop, not as membership revenues?

This is the non-profit equivelent of "bait and switch" and "premium
incentive selling" rolled into one. [A fairly profitable branch of
fund raising, for a non-profit organization.]

how is it optional and yet still a sale & thus getting within a loophole in the guidelines?

The purchaser will claim --- rightfully --- that they purchased the
object. The non-profit will claim --- rightfullly --- that they did
not sell the object. [At least, before the spin doctor for the non
profit gets into the act. How they will describe the transation is
anybody's guess.]

The net effect is that the item is sold, and the stated requirements
of the licence are adhered to.
