First you have to ask yourself. Is marriage a religious institution,
a government institution or both.

If you answer Religious...

Then the Government has no right to determine what is and is not
marriage as per the seperation of church and state.

If you answer Government...

The government cannot discriminate it services to people based on
Race, Religion, Sex and a few others. So, gays cannot be turned down
from getting food stamps simply because they are gay. Since Marriage
is a government service everyone is entitled to equal access.

If you answer Both...
That would mean that there are actually 2 seperate institutions and as
such the previous arguments still apply to their respective
catagories.


The easiest solution would simply be to scrap the Civil Union as it is
seperate but not equal. I would suggest gay marriages fall under
Common Law Marriages as those marriages are equal.
