I prefer the consistent approach... other spells that have this issue have
historically asked the user up front what version they want, with a warning
the new (or old) version may not work with some things.

That having been said, your proposed approach is like the above but with
additional work by you to verify when there actually is an issue and make
it even more seamless to the user, so I can't complain if you go ahead and
do it that way.
