I guess we must be doing something different than you.  I offer my members a $50 rebate if they do 12 hours of work on the farm and when I asked the question to both my insurance and NY several years ago I was told that this would be considered like PYO, not employment.

I specifically asked this very question and they said no.  There is a clear separation of labor and solid legal definitions concerning U-Pick.  Workshare CSAs are not covered under these.

Re the CSA members working on the farm.  This can usually be treated as an extension of a pick your own operation.  The members are paying for the opportunity to have an experience on the farm.  Just be sure to have a PYO rider on your farm liability policy.
