The main thing that fuels a class action suit is the ability to punish the
perpetrator by getting a monetary award. The people who try to sell viagra
through unsolicited email are mostly losers with no money, so there's no
financial incentive.

I also really hate spam, and even use www.spamcop.net to filter my email, but
also hate how its tainted even the legitmate use of email for business
purposes. As an example, we have three email lists on our web site that are
voluntary-- customers or anyone can join the mailing lists. However, when I
send out an announcement, I invariably receive a spate of horrible emails
accusing the company of spamming.

To get on the list customers have to first fill out a form, and then respond
in email confirming they wanted to join, so there's no way to accidentally
get on our list. Joining a mailing list and then simply not wanting to be on
it anymore is not a reason to shout "spammer".
