For some types of data distribution, that scenario has already occurred.

Let me rephrase that.
DRM-Monopolistic Dave exists in the right-here-right-now, and claiming a fee from both the users of the content, and the content providers. Adding insult to injury, content-providers provide content only at the personal whim of DRM-Monopolistic Dave.

The real questions are:

* Should CC-BY work be allowed on the platform that DRM-Monopolistic Dave controls?

* Should CC-BY-SA work be allowed on the platform that DRM-Monopolistic Dave controls?

* Should CC-BY-NC work be allowed on the platform that DRM-Monopolistic Dave controls? [And/or replace "CC-BY-NC" with "CC-BY-NC-SA" or "CC-BY-NC-ND".]

* Should CC-BY-ND work be allowed on the platform that DRM-Monopolistic Dave controls?

If the answer to all of the questions is "yes", then the entire discussion is pointless.

If the answer to any of those questions is "no", then what is needed is:
* Does the CC Licence prohibit the action?
* If it does not, then how should the clause be phrased, that will prohibit the action?

FWIW, DRM-Monopolistic Dave's platform is, using Debian Legal's definition, "non-free".
