That could be. It would depend on how "artistic" the HTML is,
versus how "functional" it is. If the code is creating HTML
that renders into an already existing format, then no one can
really claim artistic control.
i.e. if this is for laying out a blog, which all have some fairly
common rendering on the screen, then it's probably more functional
than artistic.
