Hola hace unos dias una gente de LaRioja se preguntaba lo mismo que el chaval este, Bram, y montaron algo como esto a modo de "deves aceptar estas condiciones para subir material a esta web" `pues su objetivo es promover grupos riojanos que haban musica bajo licencias copyleft http://www.errorfatal.net/public/grupos_riojanos/grupos_riojanos/mp3_licencias/licencia_copyleft.htm me preguntaron mi opinion y no siendo yo abogado le pase la pelota a David Bravo por el hecho de que lo tenia en el messenger y eran las tantas de la noche, al resto no os puedo dar la tabrarra tan facilente (por suerte para vosotros). Opino que era correcto y añadio este parrafo "Si fuera subido algún tema registrado en la SGAE a este servidor, GruposRiojanos, no se hace responsable de las acciones que la SGAE pudiera tomar al respecto, ya que es el grupo el que se comprometió a que no se diera tal efecto y además la LSSI dice que los prestadores de servicios de intermediación no somos responsables de los datos que alojen en el servidor si no nos constara que vulnera derechos de terceros. no se que os parece en general pero estaría bien tener algo asi preparado por que van a ser muchos los que pregunten lo mismo". I.e. the basis of it will be a central server to which people can upload samples (with a proper CC license) and download samples. And, upload changed versions of downloaded samples. I'm talking about samples as basic building blocks of musical pieces, not samples of movies, ... think bass drum / snare drum, field recordings, ... We are looking into creating a big community, with lot's of users and heaps of samples. Hopefully. But now the problem arises: how do we (the people who host the server) protect ourself against possible infringements? How do we make sure that when the user clicks "I agree" in the online license (i.e. how to MAKE this license) is legally binded to upload only CC-typed material? How do we protect ourselves from people uploading commercial samples of sound in a LEGAL way (i.e. no a practical way)? The CC licenses all assume that the signer of the license is providing the material himself and thus of course abiding his own license. It's a license for the true content creator towards other people. Is it possible to create a shrink-wrapped license (as Philippe Aigrain mentioned to me yesterday on a conference), and if so, how do I do this? I'm having trouble finding the right person to help me with this.
