hey all

leigh - although i take your point and actively encourage adoption of the broad cc licences, we support the opening of private rights in any way that makes copyright more useful for users and creators.

one additional quick comment, format shifting is permitted even under the no derivative licences:

the wording of the CC BY-NC-ND 3.0 Unported states:

3. License Grant. Subject to the terms and conditions of this License, Licensor hereby grants You a worldwide, royalty-free, non-exclusive, perpetual (for the duration of the applicable copyright) license to exercise the rights in the Work as stated below:
  1. to Reproduce the Work, to incorporate the Work into one or more Collections, and to Reproduce the Work as incorporated in the Collections; and,
  2. to Distribute and Publicly Perform the Work including as incorporated in Collections.

The above rights may be exercised in all media and formats whether now known or hereafter devised. The above rights include the right to make such modifications as are technically necessary to exercise the rights in other media and formats, but otherwise you have no rights to make Adaptations.

similarly the CC BY-NC-ND 3.0 Aus states:

3A Grant of Rights

Provided that the terms set out in this Licence are satisfied, the Licensor grants to You a worldwide, royalty-free, non-exclusive, perpetual (for the duration of the applicable copyright) licence to exercise the following rights:

  1. Reproduce the Work;
  2. incorporate the Work into one or more Collections;
  3. Reproduce the Work as incorporated in any Collection;
  4. Distribute and publicly perform the Work or the Work as incorporated in any Collection.

3B Media, Formats and No Derivative Works

The above rights may be exercised in any media or format whether now known or hereafter created. They include the right to make modifications that are technically necessary to exercise the rights in other media and formats. Other than such technical modifications, You have no rights to make Derivative Works.

Tama encouraged educational media producers, even students to use more liberal licenses, but was left high and dry by the producers of this video, looking slightly hypocritical as a result. 

The Non Commercial restriction prevents me loading it to other commercially sustained video sharing sites, certainly most educational institutions these days, perhaps that was precisely the reason, this is the Australian education sector after all.. The No Derivative restriction prevents transcriptions, translations, sub titling, or maybe even copying it into an open standard format. Certainly I can't do anything with it but watch it at the location prescribe by the College. 

I don't mean to be harsh, but how does the College, with a pretty high percentage of funding from Australian taxes, justify these restrictions? How did Tama come to give release for recordings of his face and words in this? Especially when it portrays the producers, and even Tama by association, as being more conservative than the Australian Government these days! 

There must be a reason, I'd like to know, it wasn't apparent in the video.

Hi Catherine,

Glad it looks useful for your purposes. :) The point of the videos is
to share them, so obviously you can embed the YouTube video right now
if you want to.  The video us up under a CC license (BY NC ND), but if
you want a decent quality version, you might want to contact the COFA
team who filmed and made the videos.  The main contact person for this
is Simon McIntyre (LTTO Project Leader) s.mcintyre AT unsw.edu.au (Phone
