There was indeed company literature quoted on the website linked to in the original post on this subject: a photograph of one of the seed packages in question.

I have not myself investigated the photograph, but I've passed the link on to NOFA-NY, and they are investigating this (and yes, they are themselves a reliable source). When I hear more I'll get back to this list.

What's enforceable is, of course, a matter for the courts.
