Well, they need to do their homework a little better. Yes, there is a federal agency that is doing a campaign called Resale Roundup. They aren't targeting garage sales or your local church bazaar. They are targeting resale stores and internet stores. And why not? If you are selling something that is known to be dangerous and has been removed from the shelves of stores, what the heck are you doing selling it anyway?
CPSC is working with NARTS, the Salvation Army and several other organizations to "alert re-sellers about recalled products . . ." etc. AND, NARTS (National Association of Resale & Thrift Shops) is in full agreement with CPSC about getting recalled products off the market.
Now, as to the little girl in Tulare. She wasn't doing this in front of her house like most kids do. Her mother packed her up and took her to a busy street corner. The code official was at the corner doing something else when he informed them it wasn't *safe* to do that on that corner and that he thought they needed a license. He helped them pack up their stuff and then offered to help them find a better place to sell the lemonade. And the kid got what she wanted without having to sell her lemonade -- free tickets to Disneyland.
