I'm a bit late in replying to this, but anyway, the idea is only to make license info in mp3s and the like as reliable as license info found on the web, by making them one in the same -- the license info for an mp3 now lives on the web.

Yes, someone can create a web page purporting to grant a license for content they have no right to do so for. That content may be a mp3, an image, or the text of the web page itself. The solution in all cases is the same -- the actual rights holders can demand that the pages be taken down.
