Interesting points. However, I think we're in the same situation --
both of us are publishing Creative Commons-licensed works contributed
by other creative people.

Neither you nor I have the information to see if work submitted to our
sites has had the rights cleared. It's actually much harder for us to
figure this out than for the contributor who created it.

Aren't you a bit worried that we would both be significantly more
exposed to legal risk if the warranty clause is removed? Likewise for
other aggregation or spontaneous collaboration projects that depend on
CC licenses to let people work together?

Is it really so much to ask for creative people to pay us back for
providing these free promotional, collaboration and publishing
services by _at_least_ not putting us in legal jeopardy? To not make
us spend hours and hours trying to clear rights on works -- that
people downstream for us will just have to do again? To not deny the
services we're creating to other users and creators by getting us shut
down entirely because of their carelessness?
