Yikes. I just moved to SC.. so I am unaware of our laws here but I carry 1mil in personal liability insurance coverage for myself. It isnt too expensive and worth every penny for peace of mind.

PA has at least five (5) so called Good Samaritan laws.  The applicable one in this case says you render care in accordance with your skill level in the manner in which you have been trained. This does not mean you cannot be sued, only that you have a defense. Injections are not authorized or trained in any first aid course below EMT-I which does include auto injectors.  If you are state certified in PA, and first responders are again a state, not a Red Cross, cert you get no protection if you use an injectable substance or auto injector except under the direct supervision of a practitioner allowed to do so. Our about to retire Director of EMS has also declared that under the new state  EMS law patient care begins as soon as you yell at the patient to see if he is conscious and responsive, even if all you do is watch afterwards.  If they ever get the rules finished you will need a provider license to hand out bandages at any organized event, or watch a subject in the woods until more qualified personnel arrive.

If you are being paid to respond (and in those states where you get workman’s comp paid for by somebody else you are being paid) you are no longer a Good Samaritan but a responder.  If you do not have a duty to respond but do so anyway you are accepting the risks associated with it. Cops, firefighters, and EMS cannot sue property owners for causing the incident because the US Supreme Court ruled that the risk of dying was part of the job.

(The other PA laws cover medical personnel being required report child beating, spousal abuse, drug abuse, and taking blood samples after accidents being investigated for DUI.  Again, you can still be hauled into court but unless you acted unprofessionally you have a defense.)

And legally, unless the judge will dismiss you from the complaint you may be innocent but still pay damages because you have the money.  SEPASAR carries $1 million in public liability that includes Good Samaritan defense and professional decision making. Irv carries $2 million more in horse liability coverage because PA EALA is not worth the paper it is printed on.

Don't you have a Good Samaritan law that would protect those otherwise unqualified who are trying to render assistance in life threatening situations?
