I've taken a look at the ati driver page and maybe an update to
the latest version (8.40.4) solves this issue. The release notes for
8.39.4 say:

* The kernel module build no longer fails on kernel version 2.6.22.

Unfortunately I can't test this, as I'm running xorg-modular on system
and ATI is unwilling to support it.
