As far as I know, CCA isn't used anymore, see for example
http://www.epa.gov/oppad001/reregistration/cca/cpsc.htm It wasn't really
banned, since the industry voluntarily withdrew it. That's probably a sign
that safety concerns were enough that the company lawyers wouldn't take on
the fight.

In the box stores it has been replaced by ACQ:

I don't know much about it, really, but I've been on some gardening forums,
and I have kids. My understanding is that the biggest risk for CCA exposure
is when the wood is new - it is practically wet with CCA - and when there is
direct contact, as in a playground. I recall reading about CCA washing off
for a time when the wood was first installed, and contaminating the soil.

Most gardeners will not use CCA when in close contact with vegetables.
Given that there are other alternatives, I personally wouldn't use it in my
landscape or gardening areas. But I've never heard of any studies measuring
an arsenic level in fruits or vegetables near CCA treated lumber.

I'm wondering if CCA treated timbers will leach arsenic in the soil
where fruit is growing. I thought CCA was banned a few years but
maybe not. The lumber yard knows nothing when asked.
