It would depend on the status of the owner. If he was not in the business
of selling the fruit then he would have no liability. If he was in the
business of an orchard then he could have some liability as he no longer has
immunity and his status changes. This is under Iowa law. Judson L. Frisk,
an attorney in SW Iowa, where we have 3 feet of snow and have a forecast of
8-10 inches more.

Hello,
I have a legal question regarding ground hogs. Any lawyers on the list?
If a person is injured on private property because of a hole made by a
ground hog, and the property owner has done nothing to contain the problem
or warn visitors to the property of the risk, is there potential for major
claims to be made against the property owner?
Possibly a U-Pick orchard person could answer this question as well.
