No, they have patented varieties, but many of the varieties on the market are patented, Monsanto and others. And that still doesn’t address the issue of “right-to-enter”. It would be a very different issue with patented varieties vs patented genes. And frankly, almost all of the varieties Seminis offers are from breeding work done years ago, mostly by Petoseed, before Seminis bought them out. Packman broccoli is an example. Many of those patents have run out or are about too. It would be a waste of time for them to pursue it for very little reward. Makes no sense to me.

Are you sure Monsanto hasn't patented genes from non-GMOs?

I would like to see that tested in court. Its one thing to prevent someone from saving seed of a variety that has a patented gene in it. There is a long history and, I believe, court precedence for protection, of saving seed of hybrids that do not have patented genes.
