Here in Texas, we have a state-wide organization of farmers market
associations that exists in large part to supply low cost liability
insurance to the member associations. The cost depends on the number
of members of each association, but, as I recall it is in the range
of $125-$200 per association per year. Each association may operate
multiple markets.
I'm not sure, but I don't think it covers product liability, but
accidents occurring at the market site. The amount? I don't recall,
several hundred K? I believe Gary Rowland is up on this, perhaps he
will respond.
I no longer do any significant amount of pick-your-own, so I no longer
worry about not having farm liability insurance. Quite a few years
ago, I priced it at one insurance company and found the cost to be
prohibitive for the level of my sales. Something like $500-$800 to
cover my $10K in sales; or in the range of 10%. I did un-insured
pick-your-own for many years with no threat of claims.
There has been some talk in the last year or so of grocery store
customers wanting their suppliers to have product liability insurance,
but no one has forced me to get that either. I understand that
suppliers that want to establish a new vendor relationship with a
grocery store chain are likely be asked for proof of product liability
insurance.
From general chit-chat with other truck farmers, I get the impression
that many insurance companies do not want to fool with farm insurance;
OTOH, there are some that do. Your task is to find the latter.
I must say here that I am opposed to buying insurance of ANY type
simply because of the low benefit/cost ratio; insurance companies
generally pay out for claims about 1/2 of what they take in for
premiums. And having insurance encourages spurious claims.
