There are some public places in the UK where professional photography requires a permit, such as Trafalgar Square (source [1]). What happens when someone publishes one of their amateur snaps under a CC licence allowing commercial activity (see [2] for example)

I guess the statute that imposes this requirement would have more to
say, but it isn't identified by source [1] -- any ideas?
Best I can find is [3] which states

"no person shall take photographs ....for the purpose of or in connection with a business, trade, profession or employment or any activity carried on by a person or body of persons, whether corporate or unincorporate"

Seems fairly broad but IANAL!
