And it's because of BY. :-)

The first criticism in the email can be avoided by the author waiving BY when
they contribute.

What does "tentacles of evil" actually mean? It sounds interesting but I
can't make out what the FAQ entry is trying to say or how it really applies
to the CC license.

Are the restrictions on the CC trademark found in CC-BY-2.0 worse than fair
use? It reads as if I cannot write an article on CC with the logo on the page
as an illustration and release it under a CC license. (IANAL, ICESP*).

I'd hope not, but unless Lessig has some really hypnotic PowerPoint slides I
can imagine they'd go for the equivalent of BY-NC.
