BEUC CAMPAIGN ON DIGITAL CONSUMER CHARTER
Call for Artist Participation & Solidarity!
³Many of us aren't aware that our fans can be sued for having music that we
want them to have - It's clearly not just about protecting our rights, but
even more about stopping our fans from being unwittingly criminalised.² TV
Smith, singer/songwriter
Call for Artist Participation
You have been recommended to BEUC / Fading Ways as a possible artist
participant for the upcoming Digital Consumer Rights DVD / CD project: BEUC,
the European Consumers¹ Organisation, is financing a campaign to raise
awareness about the plight of independent artists and consumers alike, when
faced with increasingly restrictive Copyright legislation that is narrowing
the scope of the free exchange of culture on the internet.
Consumers are enthusiastic supporters of creativity, of music, art and
literature. The new European legal framework limits the rights of consumers
in many ways; in addition consumers are often stigmatized as cyber-criminals
or ³pirates² in the digital environment. Big players dictate the rules of
the game overruling those who do not want to engage in hostile relationship
with consumers.
Please take a look at the license attached, which allows you the choice to
participate in one or both of the DVD/CD projects, and get in touch with our
Musical Coordinator, Fading Ways¹ Neil Leyton: nleyton AT gmail.com to
contribute a song to this new artist-consumer alliance.
The Digital Consumer Charter:
BEUC, The European Consumers¹ Organization, is launching its awareness
campaign based on the following 7 principles:
Both consumers and artists must have the right to:
1. benefit from technological development
2. an open and competitive market
3. cultural choice and diversity
4. accessible and interoperable content
5. the freedom to creatively and fairly use content
6. a transparent information policy
7. privacy and data protection
Launch
This campaign will be launch at the Creative Economies EU Conference (taking
place in the UK) on OCTOBER 4th 2005, with press conferences in a number of
countries where there are national BEUC members involved.
Core message and tools
The core message of the campaign is the Digital Consumer Charter (see
below). The support from artists shall create a public & artist alliance
that is urgently needed. This campaign will most likely be followed by a
conference in the next year that focuses on the public-artist relation. Many
needs of consumers will also enhance the position of artists, allowing
further market access to independents.
The campaign will be supported by
- A study on diversity of online catalogues
- A study on interoperability.
- A DVD featuring interviews with academics, musicians, artists and
consumers, as well as 15 tracks of music licensed under Creative Commons
- A commercial CD licensed under Creative Commons that will feature
participating artists, released and distributed by Fading Ways Music
- A website on digital media consumer charter which will focus on the main
problems encountered by consumers, rebuttals to industry threats and of
course the charter.
The Digital Consumer Charter supports the following notions:
- solutions for the on-line development of music (P2P exchange services or
business platforms) that are ethically sound and mutually beneficial to the
public and the creators and performers are needed;
- a legal framework that will encourage new means of exposure (MP3blogs,
podcasts, P2P, etc.) and guarantee remuneration to creators and performers,
while providing the public with new means of access, discovery and new uses
is needed;
- the possibilities of new methods of creating and sharing works shall be
encouraged;
Demanding that
- access to culture shall not be held hostage to business battles involving
standards, control systems and formats;
- creativity shall not be held hostage to excessive concentration by the big
players currently controlling the entertainment sector.
It is time for Artists and Consumers to take back their marketplace!

TV Smith discuss the present situation, and TV¹s upcoming participation in
the DVD and CD projects - we are now looking for submissions from additional
rock, folk and world music artists wishing to make a statement that they do
not intend to criminalize their audiences.
