The driver is in control of all aspects of the vehicle and is
responsible for the proper conduct of the passengers (within reasonable
limits, but I think this would be reasonable).

For example, there are laws limiting open beer cans in cars. If you are
driving and your passenger is drinking a beer, you are still subject to
arrest or citation, even it's clear you never took a sip.
