Hong I understand will try to write in something or have someone help her read her comments, since she will be in BJ and not HK.

I will be the moderator and the co-host so I will need someone to say these things.

Thanks!
Charles

Charles, Ying, and Jack,
I am so glad you can attend the ICANN meeting on Friday. What can I do to assist you?  The IRT Report is lengthy and difficult (on purpose, to make it difficult to criticize).

In Sydney, since we had only a few minutes at the microphones, everyone took a difference piece -- and expressed their concerns based on the work of their organization. One group criticized the IP Clearinghouse, another the Globally Protected Marks List, another the URS (too rapid take-down system for domain names).  We also referenced NCUC's general deep concerns about the other issues.

Please feel free to share ideas, and I am happy to assist with editing, links or examples. Like Sydney, you will only have about 2-3 minutes at the microphone. Having a short written statement worked well for me (NYC) and Konstantinos (London).

Rebecca has done a wonderful job laying out (and writing) key documents below. I have a few more....

1) The outstanding comments of Leslie, Guan Yuanyuan (Legal Supervisor, China Organizational Name Administration Center). These comments analyze and compare Chinese trademark law and US trademark law. They argue that the IRT "ignores the difference in state's jurisdictions, ignores the protection of domain name registrant's rights, and with the paranoiac and simple intention protects the rights of trademark holders" (from closing comment). Leslie gave terrific speeches in Sydney and you will like these comments! -- at http://forum.icann.org/lists/irt-final-report/msg00129.html

I have copied her above.

2) The strong comment of Dr. Hong Xue, Chinese Domain Name Users Alliance, and her opposition to the IP Clearinghouse and Globally Protected Marks List because: "ICANN, in its limited technical coordination role as declared in its mission, has absolutely no authority to create any international or even global law to change the territorial nature of trademark rights. What is recommended by IRT is to set up a private ordering through ICANN DNS governance to create a de facto global enforcement for trademarks, irrespective of legal limits of trademark protection."

Hong's full comment is at http://forum.icann.org/lists/irt-final-report/msg00138.html

3) My speech in NYC is posted on YouTube at http://www.youtube.com/watch?v=AgUC869bTVM (please let me know if you would like the text).

Good luck in HK!
Best,
Kathy

Thanks Ying and Jack!

Not many from CC-HK signed up for the event yet.  Most are from regional registries/registrars and legal and business communities and there may not be enough ones there to speak on the civil society concerns.  So I hope more of you can come.  Pls register asap.  Thanks.

Hi there Charles,

For those from the non-commercial sector and free culture/free speech components, you may want to pass around a few materials. The non-commercial constituency at ICANN is strongly opposed to the IRT proposal for trademark protection on both substantive and procedural grounds. Details via the following two links:

Also note that I wrote a blog post recently about free speech and ICANN:

..and about China's re-engagement with ICANN for the first time in many years:

I'm copying Kathy Kleiman from the NCUC who led the effort against the IRT in New York and who I'm sure will be happy to provide more details.

Best,
