If it's a fruit plant, a copy of The Register of New Fruit and Nut Varieties
by Brooks and Olmo will help. The ASHS publishes descriptions of new
patented plants in their HortJournal, so a search of back issues will pick
up ones later than the book. Patents are for 17 years. For instance,
Reliance grape, which is patented, ran out this winter on Jan. 10, and the U
of Ark. says no royalty payments are required after that date.
