Lois,
 
We decided that a non profit corporation was the most suitable for our purposes ;
 
a) It is independent from any agency that calls us out.
 
b) It is a stand alone entity that has perpetual life , i.e. it is not restricted to possible changes of local political whim
 
c) It can sue and be sued ! - It can perform all functions necessary to its well being , purchase insurance coverage if required , etc.
 
d) By virtue of our articles we decided we wanted to provide for other units in geographically different parts of the state to be formed ( expansion ) AND we provided for education outreach . As a result of that we now offer "affiliated" groups in our region NASAR training and exams.
 
Talking with other folks one item that seems to loom large is the ability to be independent either of your sheriff's office or whatever , if you are good you will be called , the independence just means you can train and work without direct political influence - sometimes this is no big deal other times it can be very inhibiting. ( Where we are based we have an excellent relationship with all the authorities but not every one is so lucky )
 
As far as where we fit in - for us we act directly at the request of the Sheriff's office in our county , in other areas it can be a mutual aid agreement where we have pre-agreed to assist. Locally we are a "volunteer" resource that assists fire , ems, SAR or the SO - we are known to be willing to help but NOT sticking noses in where not needed - i.e. we leave professional work to the professionals , when we are called we are given broad mission parameters and we work out how to execute the mission.

As we are forming our new MSAR group, we are wondering what is the best way to organize our relationship to the community.  We  have the blessing of the County Sheriff and wear uniforms that identify ourselves as a sheriff's group.  However, we are not funded by the sheriff's office although the group coordinator is a deputy sheriff.  We are considering having a free--standing non-profit structure. 
 
The discussion about liability and insurance makes me question how we should be structured. I would like to see an organization chart showing the relationship of your MSAR group to other groups and agencies in your community.  What is working and what is not?  I see some of the issues tied to organization structure  as being liability, funding, ability to be called out, community status, etc.  What other issues are there?
