Just a few comments on the subject of these unique Brassica crosses such as
broccolini. That family of vegetables, the Brassicas, is genetically
"plastic", which means that they cross readily and can easily result in new
forms. That's probably how broccoli, cauliflower and brussells sprouts were
discovered to begin with. So even though there are unique patented varieties
of broccolini and other new types, that doesn't mean you can't develop
similar crops that are not patented. The problem is that someone needs to go
through the breeding process (several years) and develop new varieties of
crops similar to broccolini. You couldn't use the term broccolini. It's
already trademarked. But you could create a new term and trademark it
yourself. Something like "Cauli-dok-tor". It's an incredible genetic family
with lots of opportunities to create new culinary delights and grower
opportunities.
