Yes it is illegal here but some of the farmers let it go because she is a single mom of 2 kids, but all of us would like the 'organic' advertising to stop. The first year I moved to this area I bought from her for my families consumption because she was 'organic'.

Sounds illegal to me.
In my area I would report her to the Better Business Bureau, the extension,
and the USDA. But, you'd better have your ducks lined up on this one
because you are accusing her of fraud. Your taxation people might be
interested in this business.
