NGOs have completed their submissions. The lines of battle are very clear. Right holders NGOs want the status quo to remain. They want a reaffirmation of the 3 step test. They prefer a treaty that seeks to incentivize creators and publishers of works. They favour commercial availability and price discrimination based on incomes as the preferred models for making content available to the visually impaired persons (VIPs). NGOs representing users on the other hand want an instrument for VIPs that places no burden on the authorised entities or rather institutions that offer a service to the VIPs. One of those burdens is the requirement to keep records of uses or imports; they want provisions of the treaty to override contractual provisions that may not be aligned. They want to be able to import accessible format copies. They want a provision that enables VIPs to bypass technological protection measures.

Dear Charles:

thanks so much for the update. Very interesting indeed. Please keep us in the loop. In particular, I think this list would be quite interested to know what the view of the African Group or individual African delegations on this is - and perhaps even by whom Africa is being represented at these meetings to reach out to them at some point.

Btw, I encourage everyone on the list to share similar experiences / reports on events with us.

This week I have the rare opportunity of taking part in deliberations of the Standing Committee on Copyright and Related Rights (SCCR) here at WIPO in Geneva as part of the delegation from the South Centre. There are about 3 issues on which member states will deliberate including limitations and exceptions for visually impaired/persons with print disabilities; limitations and exceptions for libraries and archives and; limitations and exceptions for educational and research institutions. A treaty for the visually impaired has been proposed and this morning the member states will be poring over the text and also whether the issue of visually impaired persons is best handled through a treaty. Meanwhile the libraries, archives, educational and research institutions seek to have limitations and exceptions deeply entrenched in copyright laws to enable them function well.
