Excellent point you make. Thanks for the clarification Tobias.

Dear Bukola and all:

while I do not have a link to any documents supporting PAIPO (anybody?) I just want to mention that my own view is that the idea of PAIPO is not per se a bad one. This could present our continent with an excellent opportunity of building a truly Pan African IP organisation that takes into account and gives a voice to our unique concerns and requirements in as far as IP protection (and access to IP material) is concerned. The existing institutions have not always done this in the past. So in short, this could mean a fresh start to many of the necessary discussions in the area of IP in Africa.

This said, my key concerns of the PAIPA initiative relate to (a) the level of secrecy around the planning of PAIPA (did anybody know about the AU's plans until very recently, and if not, why was this not debated more broadly?) and (b) the lack of public interest considerations especially in the preamble to the draft statute of the new organisation. I think it is especially the latter that Dick's petition aims to address.

I believe that as Creative Commoners in Africa, regardless of whether we are lawyers or not, we should all be interested and take part in the discussions around PAIPO as Creative Commons is at the end of the day a response to a unsatisfactory legal situation in as far as access to and sharing of copyrighted material is concerned. And the legal situation is something PAIPO will have to deal with. Our network is one of the few in Africa in which IP specialists look at IP through the lens of public interest - and it therefore becomes almost a responsibility to contribute our views and expertise to the discussions currently taking place.

Lets discuss this further.

Best,

Tobias

Thanks Tobias,

Interesting perspectives presented. Anyone out got a link or piece that supports or pushes for PAIPO?

Cheers,

Bukola

Dear all:

please find below Dick Kawooya's message regarding a Petition addressing the formation of a Pan African Intellectual Property Organisation as recently proposed by the AU. If you wish to read more on the proposal, here are two good sources in my view:
