Magnatune does lend itself to a bit of confusion, but the confusion is on the part of expectant browsers, not Magnatune. Magnatune does offer downloads (somewhat hidden), but it wouldn't need to offer free downloads at all in order to publish music under a Creative Commons license. It could charge for media or downloads, but permit free redistribution of music once obtained.

Personally I strongly prefer downloading to streaming, but those are business strategies for Magnatune and others to explore, not license requirements.
