That's my position, too.

Possibly because the BY clause is too much like the advertising

Still, don't you think that an artist should have the right to be properly
credited for his work if others use it?

I too think that BY should be part of a freeware/FOSS license.

IMHO, the problem with the BY part in the old BSD license was that it was too specific about the ways that contributors had to be listed.

I think that it's enough if a BY license states that the contributor list must always be easy to inspect. It need not be prominent, and it need not be repeated in every file.
One *could* also request an honest attempt at ranking the contributors by relevance. Such a clause should be no more than advisory though - it's too difficult to rank such a thing as "relevance" in a way that will hold up in court.
