WIth or without a CC license, what the publication did was wrong, and I would start with the advice given here. It has happened to photographer friends of mine before, and usually a polite phone call to the staff informing them that they published a photograph of yours without permission, and that it is a problem, is enough.
Since they already ran the photo w/o permission, most publications will send you a check for the standard freelance photography rate. In a couple cases among people I know, that usually amounted to an apology from the editor and a check for $150-500.
