I just got a call saying the Senate version of the food safety bill
(S510), which includes the Tester amendment, just passed the Senate
and while the House version is probably better from a small farmers'
point of view there will likely be no reconciliation so the senate
version will probably be the one the House votes on and is then sent
to the President to sign and become law.

The Senate version exempts small farmers that gross under half a
million from federal regulations. Of course the feds can't tell the
states not to regulate their farmers so theoretically each state
could pass its own regulations on farmers smaller than the half a
million federal limit.
