I think the FAA would be hard pressed to regulate them, I am building one for myself and it is based on nothing more than an RC chopper.

It is also my understanding that the FAA wants to regulate the use of UAVs in part for safety reasons.  They are a great tool, but have limitations in forested areas.  Dana Snyder, CAP

Many of the smaller, tactical, UAVs (we used to call them drones) can be
used by police in place of manned helicopters. They are in use today by the
Border Patrol and Coast Guard. Compared to a 3 man crew and a police copter
with FLIR they are cheap with a entire unit costing less than several hours
operation of the manned bird. A TV News quality link is not required, and
in many cases full motion video is not used but time lapsed surveillance
video after the fact. The same privacy concerns envelop these devices as
manned aircraft. The primary difference is that they are lower and slower,
and much smaller. You don't need a Global Hawk to watch downtown, even a
Pioneer will do it, and they are surplus now.

And danger has little to do with it anymore. The UAV is now small and
stealthy while the satellite is large and not stealthy and takes 12 hours to
get there. The advantage is that most military recon UAVs can stay on
station for days, which is hard on a pilot. It is a lot easier to take
pictures from lower altitudes and process direct video than it is to go to
over a 100000 feet and film or tape. The first big use of recon drones was
during Vietnam when Firebee target drones were used over the north. The
Israelis also used similar drones to fake out the Egyptian and Sryian Air
Forces.

Andy Shecktor of GPSR mounted a slow scan TV camera in a RC helicopter in
the late 1980's which had a range of a mile or two as an experiment but I
don't think it was ever used for real.
