just to second this idea, art-based game modding was the focus of a SIGGRAPH course this year - http://www.siggraph.org/s2003/conference/courses/pearce.html. there were lots of examples of videogame detournement, infusing awareness of the political nature of many first-person networked shooter games through modifications. for instance, modders would place images of terrorists & counter-terrorists in homoerotic embraces inside of a networked game of "Strike Force". apparently it got quite a rise out of many players who otherwise insist that video games "aren't political".

it's a bit different than the music/film world, in that gaming companies often actively *invite* modification based on their gaming engines. they're even releasing the engines before the games now in hopes that modders will create their own levels. maybe the gaming companies would be the first to sign up for the new CC license???

A version of the sampling license should also apply to videogame modifications and 'romhacking' (l33tspeak for modifying old console games) in that specific genre, since most mods/hacks are either translations or remixes (ranging from hardness settings to making a new game entirly).
 
Altough it may not seem important now, if people were to attempt to (CC) their own videogame this would probably become a hot topic, because right now the (CC) project seems to be focused on (CC)'d music, movies, pictures, and text. However as we move on to providing the ability to (CC) other art forms (dont know if you consider videogames to be a form of art or not, but that's your call) we should have thought ahead when we were busy tagging mp3s.
 
Just a thought to stir the cauldron of ideas.
