TRANSIT 'FAKER' BUSTS

May 10, 2007 -- Four New York City Transit employees who
claimed to be too badly injured to drive buses and run
trains were caught moonlighting - one as the drummer in a
band - even as they collected nearly $65,000 from workers'
compensation, authorities said yesterday.

The alleged pilfering percussionist, Valerie Scroggins, 44,
is accused of jetting off to Europe with her band, ESG, last
fall after begging off her bus route with a shoulder injury.

Authorities said she collected more than $13,000 in workers'
comp between last September and January.

The three others were nabbed running a real-estate
brokerage, a supermarket and a hotel room-cleaning service,
authorities said.

All were caught after NYC Transit's investigators, acting on
tips and referrals from their claims department, set up
surveillance.

"The message ought to be, to anyone who sees the result of
this, that they put themselves at very, very serious risk,"
said Brooklyn DA Charles Hynes.

"At the least, they're going to get convicted of felonies.
Certainly they'll lose their jobs. They'll make full
restitution, and some could go to jail."

Scroggins, who has played with her three sisters in ESG
since 1981, was videotaped by investigators banging away on
her drum set for the better part of an hour in concerts in
Amsterdam and Dublin last fall.

She was collared last week after a grand jury indicted her
on grand larceny, offering a false instrument for filing and
insurance fraud.

"We're looking forward to our day in court," said her
lawyer, Stacey Richman.

"Clearly, doctors have found her injuries valid. The tape
really doesn't demonstrate anything other than that she went
somewhere on a particular day."
