Karen, thanks goes to Tomi’ Finkle, not me, for the prior
posted information. She had 25 years in LE … I only had 8 years as a cop
and I turned in my badge long before I became a grandma so my “legal”
knowledge is badly out of date. ;-) From the SAR / MSAR perspective … I agree that individuals should stay current (laws change!)
within their extended response area, which in some cases may include entering
other jurisdictions or even crossing state lines, and this isn’t limited
to vehicles. Be legal, not just for yourself but because you’re
representing an organization when responding to SAR call-out, and ultimately
you answer to the AHJ … and they can also choose to send you home, cite
or even arrest you for something illegal. Also remember what is considered legal in other environments can
instead be an issue on public lands such as national parks and forests. Also
consider that in an emergency some rules/laws can be temporarily waived by the
AHJ – by law, the appropriate authorities (such as the National Park Service)
can grant an exception regarding what (and who) is allowed access, or not. An
example is a rescue helicopter allowed to land where otherwise helicopters aren’t
allowed. This type of emergency exception is requested and granted (or denied) at
the command level. Personnel who are affiliated with a SAR organization recognized by
the authorities and are directly activated to respond (as opposed to the spontaneous
volunteers who show up as word spreads) may get special approval or a request from
the activating authority to show up with X. X may not normally be
allowed. Normally the activated resource has demonstrated having
appropriate training in the use of X prior to being asked to respond and be
deployed using X. Any exception granted allowing use of X may or may not apply
