In its second reading before Parliament on April 9, the counterfeit bill draft was discarded on the grounds that the ministry of Trade, Industry and Cooperatives had not done the relevant consultations.
Trade Minister Amelia Kyambadde, who presented the bill, requested for a three months period before she could table it again before Parliament. But ministry sources, requesting anonymity, say that no consultations on issues in the bill have been done so far.
In rejecting the bill presentation in April, the Parliamentary Committee on Trade observed that various stakeholders, like Intellectual Property Rights bodies, who will be part of the law, if passed, were not consulted during the drafting period. Officials from Centre for Health Human Rights and Development (CEHURD), one of the Intellectual Property bodies when contacted for comment, said they had not been consulted on the issues of the bill.
MPs argued in April that the bill was about counterfeit trademark and copyright piracy, not production and marketing of counterfeit products. Thus the body responsible for the bill should be the relevant Intellectual Property offices. The MPs also said the Uganda National Bureau of Standards (UNBS) was not an Intellectual Property body and had no capacity to handle Intellectual Property.
They ordered the ill referred back to the ministry for redrafting in consultation with the relevant authorities and stakeholders. The bill was first read on the floor of the House in 2010. It was reintroduced in October 2011 by a resolution of Parliament and referred to the sessional committee on Trade and Industry
The objectives of the bill are to, among other things, prohibit the manufacture and trade in counterfeit goods, empower UNBS in exercising its oversight functions over the counterfeit goods and introduce punitive and deterrent measures on trade in counterfeit goods.
