Thanks Hamish, this is interesting. If the myth of copyright as a
magic circle of protection for the struggling artist was true, and if
the magic arrow power to enforce copyright was equally distributed,
you would expect to see New Scientists et al sued out of existence for
this flagrant breach of copyright, just as Napster, Grokster, and so
many others have been, or criminalized like MegaUpload, and driven
underground like the Pirate Bay search engine.
That this hasn't happened, demonstrates that copyright currently works
as a legal circle of protection for Big Media corporations and
consortia like the RIAA and MPAA, who have the money and political
influence to afford the 'shock and awe' enforcement described above.
I'm interested in whether people think the Copyright Tribunal approach
here would be helpful to people wanting to enforce the conditions of a
CC license, or whether it's only useful to those enforcing ARR
copyright.
