Yes. But you have to comply with the Collective Work requirements of the
license. You should absolutely hire a lawyer to look over things for
you. There is probably a free legal referral service in your town or
city; check the phone book for the local Bar Association, and ask them.

_I_ think there are too many good works out there that _aren't_ burdened
with the crippleware NonCommercial provision for me to bother with ones
that are.

That said, you'd be treading on some unsure territory. The NonCommercial
provision has yet to be tested in the courts. Do _you_ want to be the
defendant in that landmark case? I sure don't.

My suggestion: if there's any money involved, on a practical level you
just can't safely use NonCommercial. Send an email to the copyright
holder letting them know that you're skipping over their work because of
it.
