hi all, continuing with my current fixation on all things french i was
wondering if someone from France could provide some additional information on
this amendement to the new french freedom of panorama exception that i was
made aware of earlier today:

> « Art. L. 136-1. – I. – La publication d'une œuvre d'art plastique,
> graphique ou photographique par un service de communication en ligne

the way i read this this seems to create a compulsory levy for the use of
photograpic, visual or artistic works by publishers of indexing and search
engine services. The most obvious use case would be something a service like
google image serach, but i think the language is broad enough to apply to
things like Europeana and possibly even Wikimedia commons.

Given that this is a compulsory licensing arrangement it appears to me that
this would also apply to CC licensed photographic, visual or artistic works.
Is there anyone on this list who can take a closer look at this and tell me
if this is indeed the case? Also does anybody know if this is still under
consideration or if this has already been adopted?
